McCann appeal to forbid the sale of the book of Gonçalo Amaral

The McCanns appealed to the Supreme Court of Appeal decision to forbid the sale of Gonçalo Amaral's book "Maddie - The Truth Lies," the couple´s lawyer told.

Isabel Duarte, a lawyer for Gerry and Kate McCann, who were today in London, said that the appeal was delivered to the Supreme Court on November 5, requesting the annulment of the decision of the Court of Appeal of Lisbon on October 19.

On appeal, the couple´s lawyer who told that the Tribunal da Relação "did not take into account facts that, throughout the process, were never placed in question" and said that "these elements were not analyzed" by the judges judges, to overturn the decision of the Court of Civil Lisbon following an injunction filed by the parents of Madeleine.

"The Tribunal da Relação did not consider that the book was made to make money, to deepen the pain of the McCanns and to jeopardize the investigation," said Isabel Duarte, who has not returned the book to the publisher of Gonçalo Amaral War & Peace, so that the work of the former inspector returns to bookstores.

The couple´s lawyer, trustee of the copies of the book for the determination of the Civil Court, said that "nothing will force her to deliver them until there is a final decision" of the Supreme Court.

In January, the Lisbon Civil Court dismissed the injunction filed by McCann (provisionally decreed Sept. 9) and decided to maintain the ban on the sale of the book of Gonçalo Amaral and banned the former Inspector of Judicial Police from giving interviews or in Portugal and abroad.

The Tribunal da Relação came after the appeal of Gonçalo Amaral, who defends the book's thesis involvement of Kate and Gerry McCann in the disappearance of her daughter in May 2007, a tourist apartment in the Algarve.

Besides this case, Kate and Gerry McCann brought a lawsuit against Gonçalo Amaral for defamation, in which he is claiming damages of 1.2 million, and another for breach of secrecy.

Madeleine McCann missing on May 3, 2007, in an apartment in a resort of Praia da Luz, Lagos, where he was vacationing with her parents and two brothers.

As coordinator of the Criminal Investigation Department of the PJ in Portimão, Gonçalo Amaral joined the team of researchers tried to find out what happened to the English girl.

Kate and Gerry McCann, who always maintained the position that Madeleine was abducted, were made defendants in September 2007 but were eventually acquitted in July 2008 for lack of evidence to support the hypothesis advanced by the investigation of accidental death of the girl. The prosecutor filed the case as well, which could be reopened if new evidence considered consistent about the disappearance of the child.

But in any case, it is good to know that this petition is being advertised all over and that Isabel Duarte' appeal and decision are also being made known.

I would suggest they read some of the comments already on the petition and also make a point of telling them that the government is witholding information contained in the UK report on the case, saying only that it is "case sensitive".......in other words who is the UK government protecting and why?

I wish that it was that easy. This is another Doctor who obviously doesn't have a clue. I expected him to sign it, or not. I did not expect to be questioned. But I will be questioned next week when I meet him for the first time.

I have recently come to work for him without having actually met him. But even I know that I don't always sound rational about this subject. Not that I care about that. He can stuff his job if he thinks I am nuts.

But this bloody Petition is so much more to us than just 33,000 signatures. It is the epitomy of what Middle Britain thinks of The PJ. Try explaining that one without sounding like a paranoid lunatic.

Sheesh, I have another client who owns a Villa in Praia da Luz. Really nice people, and even they are pissed off with The McCanns. They told me how easy it would be to whisk a child away into the hinterland. And they were talking about The McCanns doing it. Forget your average Abductor. They don't even want to think about that. Too bad for business. We don't even talk about it anymore.

Don't worry. I will think of something to say.

I am positive that the petition will reach the 100,000 mark needed for the British Government to start reviewing Madeleine's case. All of my family have taken the printed petition to school, work and around everyone that they know. It is vital to get this fact generally known because some people don't have a computer or the internet but would be willing to sign. I have taken a sheet to my local supermarket, and left it with one of the staff, who is going around every person working there asking for signatures. I carry a sheet around with me whereever I go and ask random people who serve me in shops etc. We will reach the magic number - it just takes a bit of effort.
