Maddie case opens war between PJ and prosecutors
The Judicial Police (PJ) has formed a team for the Maddie case, with elements of Oporto, without informing the Public Ministry (MP). The situation is generating unease, as it is seen as a disguised form of the PJ to reopen a case which is filed and that can only be reopened with new evidence and with decision of the MP.
When the SOL newspaper found that, the District Attorney General of OPorto, Alberto Pinto Nogueira, formally challenged the Directorate of PJ North, to know why they were outstanding elements of the Oporto to investigate a crime that occurred in the Algarve. As the magistrate pointed to the PJ, who has the authority to open or reopen an investigation is the MP and not the PJ.
team was unknown by PGR
Pinto Nogueira still wanted to know who authorized an investigation that looks more like an inquiry to what was done by the team that originally dealt with the disappearance of British girl. Is that there is no legal framework for the creation of this team.
Therefore, all questions of the magistrate - who only learned of the existence of this working group by the media - have been reported to the Attorney General's Office (PGR), Pinto Monteiro.
The PGR made known by his office that also was not aware of the new team of PJ and shares the doubts raised by Pinto Nogueira, requested to be kept informed of the responses of the Judiciary.
Once faced with a communication Nogueira Pinto, João Baptista Romão, head of the Directorate of PJ North, referred questions to District Attorney General of Oporto to the National Directorate of Judicial. Pedro do Carmo, assistant national director, Nogueira Pinto said then that this team is not to conduct further investigations into the case.
The same Pedro do Carmo said to Sol, reiterating that "the team is not to investigate, but to review the evidence gathered." And despite claiming that both the prosecutor of Portimão holder of the process as the Evora district attorney knows of the existence of this team, admits that "neither was necessary to give them, only they had seen the news in the newspapers."
According to found the SUN, Nogueira Pinto, after receiving clarification from PJ, you have made it clear that all responsibilities, including financial, resulting from this new team would be taken into account by the district attorney.
But this is an issue Pedro do Carmo also devalues the SUN: "They are employees of the PJ, who pays them the salary is the Judiciary, of course." The assistant national director does not explain, however, if the team is working exclusively on the Maddie case, has set a timeframe for this work or how many elements it is composed. "These are operational issues that can only be defined by its coordinator, Helena Monteiro" she says.
Pedro do Carmo still guaranteed to Sol that the new team is not evaluating the information have been collected by Scotland Yard - where a group of 37 policemen gathers and analyzes tips on the whereabouts of Madeleine McCann, on the initiative of British Prime Minister David Cameron.
Pedro do Carmo stresses that "what is being done is to review what has been investigated by the PJ at the time." This though is not clear from the material analyzed are the 195 new tracks that Scotland Yard says it has about the case: "Only the British police can talk about it. There are two independent teams to work, although there is constant communication. "
Different purpose in the UK
However, the aim seems to be quite different in the UK, where Andy Redwood inspector who leads the English team, has made it clear that "reopening the investigation is only way to know what happened to Madeleine and close the case." Moreover, last week, Scotland Yard announced 195 new leads and they released a picture of how Maddie might be today, five years after she went missing in Praia da Luz
What makes this source of clues is that nobody has yet explained. The spokesman for the McCanns, Clarence Mitchell, said that information resulting from an analysis of some 1,200 pages of information and that "all the material was sent to the Portuguese authorities', who still only have examined about a quarter of what given.
Rogerio Alves, the McCanns' lawyer in Portugal, also says to ignore the content of investigative hypotheses. "One can speak of the relevance of each one, knowing them deeply," he argues, adding still be waiting to receive all the material. Cautiously, the lawyer points out that "only may request the reopening of the case, if there is a very concrete evidence

Re: Maddie case opens war between PJ and prosecutors
I think I said somewhere that the setting up of a team from Oporto and not from the PDL which was I thought, a clever move. A political game is being played out in Portugal. I suspected it might have repucussions!
