Assunto: Urgent - Torture against Leonor Cipriano by the Portuguese State

I want to inform Amnesty International that I'm being a victim of illegal and brutal persecution by the Portuguese State.
As you know, I'm the Lawyer of Leonor Cipriano, the Portuguese lady that was brutally tortured by police officers of the Portuguese State. This torture, as you also know, was proven by a Jury Court, and its verdict was confirmed by the appeal court. In the sequence, two police officers were convicted for torture-related crimes, one of them Gonçalo de Sousa Amaral, the leader of the police team, which was convicted for perjury to a 1 year and 6 months suspended jail sentence, because it was proven that he knew since the moment of the crime that Leonor Cipriano was tortured by the police but he lied saying that she wasn't.
Nevertheless, after the jury verdict, the Portuguese State accused me of criminal libel for writing a report dated of before the beginning of that same trial, where the testimony of Leonor Cipriano about the torture she suffered was divulged. A university teacher, president of a portuguese association (aced) that has divulged the report, was also accused. Despite the efforts to prove that the accusation was illegal, the Portuguese State has notify us on 23 of December 2011 for us to be judged by a non-Jury court for criminal libel against the already convicted Gonçalo de Sousa Amaral!
This is clearly an evil and illegal manoeuvre by the Portuguese State in order to question the torture verdict, verdict that can not be modify by another appeal (no more appeals are allowed).
In order to guarantee the Human Rights of Leonor Cipriano and me as her Lawyer, we ask Amnesty International to intervene urgently, denouncing publicly this absolutely illegal court action against us.

Strange country, strange laws.
I could be wrong, but wasn't Gonc already an arguido before Marcos (Aced) published the report?
Wasn't it Grade who's initially started all this, the accusations about beating up Leonor?
The lawyer who's got caught with drugs when he entered prison to visit a client. (Surely any lawyer worth his salt would check what's in a package for a client in case it's something illegal, like a weapon?)
The same lawyer who got acquitted of that crime and who's suddenly friends with Amaral, attending his birthday party.
So what's behind this accusation? Amaral's network friends?

I think this may simply be intimidation. It is difficult to believe that Marcos and the other lawyer can be found guilty of libel for accusing Amaral of the crime for which he has been found guilty. Libel means it must be false, and the defamer knew it to be false, and that it caused damages. Even if Marcos overstepped the mark and accused Amaral of more than he was found guilty of (I have never read anything like that anyway but with the intricacies of law it may be possible), it will be hard to establish damages, as the man was convicted on what is essentially lying to cover up a torture.
But the question then becomes, why intimidate, or try to intimidate Marcos? And this I fear is tied to Lenore's miscarriage of justice.

Of course, that is libel as we know it in countries that follow English common law. It could be anything at all in Portugal. Marcos obviously take this seriously or he would not have taken it further. If he is convicted, does he lose the right to practice law?
It is hard to fathom how it is possible to libel a convicted criminal about the crime he committed, even if saying it prior to the beginning of the court case. It is still true.

Leonor Cipriano's lawyer, Marcos Aragão Correia, the trial opens on February 9 for allegedly defaming Gonçalo Amaral, Inspector of Police and coordinator of the investigation into the disappearance of Joan in 2004.
The hearings will be held at 2. Judgement of the Criminal Court of Faro and Gonçalo Amaral calls for a compensation of three thousand euros Marcos Aragão Correia and Pedro Antonio also accused Sorrows, president of the Association Against Exclusion for Development (ACED).
According to judicial sources, at issue is a document of April 8, 2008, entitled "Report on Torture Leonor Cipriano perpetrated by the Judicial Police," which Aragão Correia prepared for ACED and that was spread by the association.
Goncalo Amaral, who was sentenced to 18 months imprisonment, suspended for the same period in the trial of former agents and inspectors of the PJ accused of torture to the mother of Joan, considered that the report was "damaging the honor and the personal and professional"
"Torture has been proven in final court of appeal and Mr. Goncalo Amaral was convicted in this area, just for having lied to the judicial system by stating that there was no torture, when he proved that he had knowledge of the same torture from the moment that it occurred. So there is no defamation in the report, "said Aragon Correia today to Lusa news agency.
Leonor Cipriano's lawyer added that this process of defamation "is a flagrant violation of the principle of res judicata, even when you know that the prosecutor made and maintains the charge of defamation after the judgments that prove unanimously torture" .
Aragão Correia requested the intervention of the attorney general's office, Pinto Monteiro, "in order to clarify the inconsistency total and absolute illegality of the prosecutors in this recent horrendous accusation of defamation does not exist."
At the trial of former agents and inspectors of the PJ in Faro in 2009, Good Leonel Marques, Paulo Pereira and Paulo Marques Bom Christopher were acquitted of the crime, while Antonio Nunes Cardoso was sentenced to two years and three months imprisonment with suspended for two years by the practice of counterfeiting.
Gonçalo Amaral was acquitted of the crime of omission of denunciation. Subsequently, the Court of Appeal upheld the sentences of Évora.
The disappearance of Joana in Aldeira Figueira, in Portimão, occurred September 12, 2004. The child's body at the time eight years, and never appeared Leonor Cipriano and her brother, John Cipriano, were sentenced to 16 years in prison each on charges of murder and concealment of a body.

Where was his honour when threatening to kill his wife? All recorded at the PJ offices
Where was his honour when he was having extra marital affairs?
Where was his honour when he was making threatening phone calls, to shoot his lady friends husband? All recorded, I still have that recording if the PJ want it.

Marcos Aragão Correia, Leonor Cipriano's lawyer, in compliance with the manifest public interest that cover all cases of disappearances of children, and especially that of Joana Cipriano, hereby inform about the media:
1 - For us, today received the final judgment's Court of Appeal of Evora on all appeals, even by us in relation to the Court of Jury popular Judicial Court of Faro, which was about the brutal torture perpetrated by the Portuguese Judicial Police against Leonor Cipriano;
2 - The Court of Appeal in Évora considered all the evidence in the seat of the Court of first instance is amply sufficient to prove the existence of a serious crime of torture of Leonor Cipriano by police officers of the Portuguese State, in consequence declared rejected all the resources of defendants, including the intention to renew the same evidence;
3 - The Court of Appeal in Évora decided to keep the full ruling end of the first instance;
4 - This was confirmed by the Court of Appeal in Évora that:
a) Leonor Cipriano was brutally tortured by agents of the various Portuguese Judicial Police who remain unidentified;
b) Gonçalo Amaral de Sousa lied to the judiciary by claiming that Leonor Cipriano "fell down the stairs of the PJ in Faro and was not tortured," and is therefore condemned as a perpetrator of a crime of making false allegations to 1 year and 6 months of the sentence in prison, suspended for the same period (1 year and 6 months);
c) Antonio Fernandes Nuno Cardoso falsified documents in order to give the impression that Leonor Cipriano "fell down the stairs of the PJ in Faro and was not tortured," and is therefore condemned as a perpetrator of a crime of forgery of document to 2 years and 3 months imprisonment suspended for a period of two years;
5 - The Court of Appeal in Évora considered it not to aggravate the punishment of Gonçalo Amaral for this being a primary offender (no criminal record at the time of the crime) and also the same as being a retired police;
6 - Concrete This final decision of the Court of Appeal in Évora does not fit any more action at the national level, as provided by Article 400 of the Code of Criminal Procedure;
7 - As a result, Leonor Cipriano will introduce in the coming months a formal complaint against the Portuguese government to the United Nations for gross violation of the most basic human rights, calling for the condemnation and expulsion of Portugal's Human Rights Commission of the United Nations.

Marcos Aragão Correia, Advogado de Leonor Cipriano, em cumprimento do manifesto interesse público que revestem todos os casos de desaparecimentos de crianças, e especialmente o de Joana Cipriano, vem por este meio informar, a respeito, os órgãos de comunicação social:
1º - Foi por nós hoje recebido o acórdão final do Tribunal da Relação de Évora sobre todos os recursos apresentados, inclusivamente por nós, em relação ao acórdão do Tribunal de Júri popular do Tribunal Judicial de Faro que versou sobre a brutal tortura perpetrada por agentes da Polícia Judiciária portuguesa contra Leonor Cipriano;
2º - O Tribunal da Relação de Évora considerou que toda a prova produzida em sede do Tribunal de primeira instância é amplamente suficiente para provar a existência de um grave crime de tortura contra Leonor Cipriano por parte de agentes da polícia do Estado Português, tendo em consequência declarado improcedentes todos os recursos dos arguidos, inclusivamente a pretensão dos mesmos de renovação de prova;
3º - O Tribunal da Relação de Évora decidiu manter na íntegra o acórdão final da primeira instância;
4º - Assim, foi confirmado pelo Tribunal da Relação de Évora que:
a) Leonor Cipriano foi brutalmente torturada por vários agentes da Polícia Judiciária portuguesa que permanecem não identificados;
b) Gonçalo de Sousa Amaral mentiu ao sistema judicial ao afirmar que Leonor Cipriano “caiu pelas escadas da PJ de Faro e não foi torturada“, sendo por isso condenado como autor de um crime de falsidade de depoimento a 1 ano e 6 meses de pena de prisão suspensa por igual período (1 ano e 6 meses);
c) António Fernandes Nuno Cardoso falsificou documentos no sentido de fazer crer que Leonor Cipriano “caiu pelas escadas da PJ de Faro e não foi torturada“, sendo por isso condenado como autor de um crime de falsificação de documento a 2 anos e 3 meses de pena de prisão suspensa por um período de 2 anos;
5º - O Tribunal da Relação de Évora considerou não ser de agravar a pena aplicada a Gonçalo Amaral por este ser um delinquente primário (não ter antecedentes criminais à data da prática do crime) e também pelo mesmo já estar reformado da polícia;
6º - Desta concreta decisão final do Tribunal da Relação de Évora não cabe mais nenhum recurso a nível nacional, tal como disposto pelo artigo 400 do Código de Processo Penal;
7º - Em consequência, Leonor Cipriano irá apresentar já nos próximos meses uma queixa formal contra o Estado Português à Organização das Nações Unidas por violação grosseira dos mais básicos Direitos Humanos, pedindo a condenação e expulsão de Portugal da Comissão dos Direitos Humanos das Nações Unidas.

6º - Desta concreta decisão final do Tribunal da Relação de Évora não cabe mais nenhum recurso a nível nacional, tal como disposto pelo artigo 400 do Código de Processo Penal;
7º - Em consequência, Leonor Cipriano irá apresentar já nos próximos meses uma queixa formal contra o Estado Português à Organização das Nações Unidas por violação grosseira dos mais básicos Direitos Humanos, pedindo a condenação e expulsão de Portugal da Comissão dos Direitos Humanos das Nações Unidas.
