If Duarte can win on her performance, it proves something is seriously amiss with Portuguese justice. Socrates will try and control the media for political purposes. I predicted this woud be held off until after the British General election, as our politicians have put themselves in a tricky position; following their support of McCanns. Those who doubt conspiracies may look again at the evidence.

Sorry to be defeatist but I'm afraid it's time for everyone to just give up now.
This vile pair are being protected by people very high up and always will be. They will NEVER face justice.
In short, they have got away with it.
I am now going to take no further interest. I will use the energy I have wasted on following and commenting on this case to spend time with my lovely grandchildren.

Goncalo Amaral's book Maddie: The Truth Of The Lie claimed Madeleine died in the family's holiday apartment and her parents covered up her death by faking her abduction.
A judge granted Mr and Mrs McCann a temporary injunction last September halting further sale or publication of Mr Amaral's book and a TV documentary he made about the case.
Mr Amaral, who was the lead detective in the Madeleine investigation, launched an appeal against the ban last month, but a Portuguese judge has rejected his challenge.
The McCanns reacted to the ruling by vowing to continue looking for their daughter and appealing for help from the public.

"We are grateful to the judge for accepting that this injustice must not continue.
"The court case has demonstrated, once again, that there is no evidence that Madeleine has come to any harm.
"It has also clearly shown that no police force is actively looking for Madeleine, even, shockingly, when they are presented with new information and leads.

The McCanns said their main motive for challenging the former policeman is the
fear that people will stop looking for Madeleine if they think she is dead.
Mr Amaral's lawyers argued his book's material was contained in official Portuguese police files, many of which were made public when the case was shelved in August 2008.
His lawyers and the Portuguese television company that made and distributed the documentary based on his book have said they will appeal the decision.
In a separate civil case, the McCanns are seeking over £1m in compensation from Mr Amaral for defamation.
The McCanns are due to respond to the court's ruling at a news conference in London on Friday.

Congratulations to Isabel Duerte, Carter-Ruck and the Portuguese Judge who, though young, has more common sense than Amaral/Moreass et all put together! KATE and Gerry McCann were 'totally delighted' today after former Portuguese police boss Goncalo Amaral failed in his bid to get a ban on his book about Maddie lifted.

Amaral had claimed in the book — The Truth of the Lie — that Maddie was dead and her parents had faked her abduction.

Kate and Gerry, from Rothley, Leicestershire, branded Amaral a 'disgrace' after hearing that the ban had been upheld.

In a statement they said: "The motives of those who have tried to convince the world that Madeleine is dead, and who've disgracefully and falsely tried to implicate us in her disappearance, need to be seriously questioned."

They will now press ahead with a £1million libel case against Amaral which is due to be heard at the end of the year.

Kate and Gerry, both 41, won a ban on Amaral's book last September claiming it libelled them and was harming the hunt for their daughter.

Amaral, 54, applied for the ban to be lifted but today Judge Maria Rodrigues threw out his submissions that he had a right to publish his book under Portuguese freedom of speech laws.

The McCanns were said to be "hugely relieved and totally delighted" by the ruling at Lisbon's Palace of Justice.

They had attended three previous court hearings of the case but were not in the capital for the ruling.

Their spokesman Clarence Mitchell said: "They are very pleased, totally delighted and hugely relieved.

"The Judge has done the right thing by keeping the ban in place. She has recognised that this injustice by Amaral is utterly wrong and must stop.

"The judgement also recognises that what he has done is harming the search for Madeleine."

A furious Amaral, who was sacked from the Maddie inquiry after five months, stormed from the court building with a face like thunder.

He refused to comment but his lawyer later said his client would be appealing the decision.

Kate and Gerry had had to endure hearing harrowing evidence during previous sessions of the court case.

They listened as former police colleagues of Amaral claimed that Maddie had died on the night she disappeared on May 3 2007 from a holiday apartment in Praia da Luz, Portugal, shortly before her fourth birthday.

They also had accusations that they disposed of her body hurled at them and claims that they were "lying" about her abduction.

Amaral was the police boss first drafted in to head the hunt for Maddie.

Missing ... Maddie McCann

As it later transpired in his book, which he wrote in July 2008 after retiring from the police force, he began to suspect Kate and Gerry of lying about Maddie's disappearance within hours of her going missing.

As the inquiry continued instead of concentrating police efforts on finding Maddie, he appeared to have focused instead on proving the McCanns' guilt.

Amaral claims in the book that Maddie died as a result of an accident in the apartment, that her parents hid her body then pretended she had been snatched from her bed.

In court he claimed the allegations were based on official police files and called a string of former colleagues to back up his claims.

They supported his story, saying they too suspected the McCanns — pointing out that two sniffer dogs brought in by British police found the 'smell of death' in the holiday flat.

But the McCanns' lawyer Isabel Duarte claimed there was no evidence the McCanns were involved in Maddie's disappearance.

She also accused Portuguese police of failing to follow up many new leads and sightings of Maddie because they believed she was dead.

Amaral is believed to have made hundreds of thousands of pounds from the book and also from a DVD documentary based on it.

The DVD has also been banned under the court order. Since September's ban Amaral has had all his assets seized by the Portuguese courts.

The McCanns' statement told of their "relief" that the ban had stayed in place.

The couple, both doctors, said: "We are very pleased and relieved with the judge's decision in Lisbon.

"By upholding the injunction against Goncalo Amaral's book and DVD, the judge has rightly agreed that there has been significant, ongoing damage to the search for our beloved daughter Madeleine and to the rights of our family.

"We are grateful to the judge for accepting that this injustice must not continue. The court case has demonstrated, once again, that there is no evidence that Madeleine has come to any harm."

Talking about the evidence in the case the couple added: "It has also clearly shown that no police force is actively looking for Madeleine, even, shockingly, when they are presented with new information and leads."

They went on: "As painful and personally damaging as the slanderous claims of Mr Amaral and his supporters have been to us and our family, our primary focus has always been, and always will be, to find Madeleine through our own best investigative efforts.

"It is still incumbent upon the British and Portuguese authorities to ensure that every credible lead has been investigated and that a meaningful search for our innocent and vulnerable little girl is properly carried out."

Kate and Gerry ended their statement by calling on people to keep looking for their daughter saying: "We must and will keep looking for Madeleine and those responsible for her abduction.

"We implore the public, especially the Portuguese people, to help us look for Madeleine, to remain vigilant and to give us any information that could help us find our daughter."

There will be a full trial at a later date on whether the injunction banning the book should be made permanent, said Ms Duarte.

The McCanns are seeking 1.2million euros (£1.08million) in compensation for defamation in separate civil proceedings against Amaral in Portugal.

Speaking later an angry Amaral, who wears a diamond stud earring, said he would appeal the decision saying it violated his freedom of speech rights.

He also accused the McCanns of 'persecuting' him and his family.

He said: "It was an unbalanced decision and I will appeal.

"What is at stake is freedom of speech."

Ms Duarte welcomed the verdict. She said: "This decision will protect clients because they have suffered a living hell with this book and all these lies."

COPS in Portugal ignored hundreds of "sightings" of Madeleine McCann - because they believed she was dead, it was claimed yesterday.

Inspector Ricardo Paiva also neglected to show her parents "shockingly similar" photos the public had sent in believing they were Maddie - or act on tip-offs.

Instead he put every bit in a dossier after writing on it: "Not relevant to the investigation". Maddie's parents, Kate and Gerry, only learnt the file existed this week.

Maddie, now six, vanished from a holiday resort in Praia da Luz, Portugal, in May 2007.

Paiva, the McCanns' family liaison officer, started collating the dossier in July 2008 after cops called off the hunt.

It contains information from police forces across Europe including sightings, photos of houses where people reported seeing Maddie and tips-offs.

Isabel Duarte, the McCanns' solicitor, asked to see the dossier after Paiva mentioned it at a court hearing.

Kate and Gerry, both 41, from Rothley, Leics, were shown it this week while in Lisbon for a different case brought by former police chief Goncalo Amaral.

The 50-year-old, who headed the initial hunt, is fighting for a ban on a book he wrote about Maddie to be lifted. In it, he claims Maddie is dead and her parents faked her abduction.

Mrs Duarte branded Paiva a "liar" in court when he claimed he would reopen the Maddie case if new information came forward.

She said yesterday: "Every piece was treated the same way - Ricardo Paiva writes on it, 'this is not relevant to the investigation'.

"He believed, and to this day still believes, that Madeleine is dead.

"I said to him, 'How can you find a person when you are not looking for them?'"

She said some pictures of girls in the file were "shockingly similar to Madeleine".

The McCanns' spokesman, Clarence Mitchell, said they were shocked at what was in the file, and that little had been done to investigate it.

He said: "Their private investigators will follow up everything they can."

Inspector Paiva declined to comment.

This update and the statement from Kate and Gerry McCann is so significant, that it must be read by as many people as possible.
I look forward to listening to their press conference on Friday.

How can Amaral and his legal team claim that his book was based on the files before Amaral got the sack from the investigation, when 1) Some statements were actually made AFTER Amaral got thrown off of the case? And 2) How did he know what was to be included in the files?

The concluding part of the investigation was handed over to the Portuguese prosecutors and Attorney General for their deliberations and conclusions some 10 months AFTER Amaral had been sacked from the investigation. How does Amaral explain this? Is Amaral seriously expecting people to believe that he managed to remember thousands of pages of information in order to include it in his "book"? Or is it closer to the truth to state that perhaps Amaral took illegal copies of the files for his own personal use? Or perhaps someone from inside the investigation which was then being run by Paulo Rebelo was handing secret documents over to Amaral for his use, breaking Portugal's strict secrecy code?

Whatever has happened here it looks to be highly illegal, and it is time that Goncalo Amaral was arrested and questioned over the great many highly pertinent inconsistencies in Amaral's own part of the investigation and his behaviour subsequently.


  • It is time that Amaral was taken to court to answer claims that he allowed and sanctioned leaks, smears, innuendos and lies that caused the McCanns so much distress and that so badly damaged the search for Madeleine.
  • It is time that Amaral was taken to court to answer claims that he gave journalist Felicia Cabrita, sight of witness statements and the names, addresses and telephone numbers of key witnesses in the Madeleine McCann case, leading to these people being identified and contacted by Ms Cabrita and then subsequently published.
  • It is time to discover if money changed hands for that information.

Interestingly, Felicia Cabrita is set to be one of the witnesses called by Goncalo Amaral in the Leandro Silva case, which is currently being judged to ascertain if Amaral has a case to answer and if he will be forced to stand trial accused of torturing Leandro Silva.
Leandro Silva is the partner of Leonor Cipriano, who last year was successful in proving that she was tortured into confessing to the murder of her still missing daughter Joana Cipriano.

Felicia Cabrita is appearing for Goncalo Amaral along with bizarrely Leonor's former lawyer, Joao Grade dos Santos and now "best pal" of Goncalo Amaral and one José Carlos Franco Pinheiro ( he is the District Attorney of Portimao who asked 25 years of jail to Leonor).

Mrs. Isabel Duarte: "At our office, we are examining all the documentation which came from Algarve, selecting those who seems important and those who is secondary or absolutely unnecessary, in a way that I can gather with my colleagues and with my clients and all of us together take a decision about the reopen of the process, in which they have showned desire to do it, after seeing that there are several elements at the Portimao process unaware by them".

Felgueiras: "Thank you Mrs. Dra.

And so, it´s ended this trial, this saga, another saga in the process Madeleine McCann.
The book of GA it is definitely prohibited, at this moment it is prigibited. GA stays prevented of repeating his thesis that he defended or wroted in the book, a thesis he was feeding during the period he was in charge of the investigation, or believing that the child was dead and that the couple were behind the concealment of a body. The magistrate Maria Gabriela Rodrigues agreed to a request by the couple, held it in its ruling today, the right to good name prevails and therefore this cannot stay in business. It was no longer since September, now we know that it will continue to be out of business. But GA says he will appeal to wherever it needs, even to the European court of human rights.

Yeah, I was there, had the joy and happiness of knowing it in second place (Kate first, of course) but I missed all the fun and games here!!!

So so happy that only now tears come to my eyes.

Yes, I gave a very big hug to Isabel, and I thanked her. So over the moon that I forgot to congratulate her!

I was expecting to have on my mail the press release, but it is not there yet.

Off the topic, but I can't resist: Jo wasn't there neither was Cabrita, but the Gonçallettes were, along with a decent number of 'supporters'. The louder Gonçallette had a red carnation on her ear and a beautiful white rose on her hand. The rose wasn't delivered... Then she came down doing her job, that is, shouting. At a point in time she probably had a 'blank' and shouted furiously : 'Long live the portuguese justice!' (viva a justiça portuguesa) to which I imediately answered 'Long live!' (viva). Ms. Duarte is true lawyer and true patriot. She took on this case because she knew her countrymen had done wrong and that everyone deserves justice. She did so knowing it could have ill affects on her and her business... I admire her fortitude and courage, and yours, too. :)

Also, Amaral will appeal, however unlike other situations (Leonor's trial, when he was sentenced, that sentence will not take effect until the appeal is decided) this appeal does not have any suspensive effects, that is, no matter how many appeals there are and how long they take, this ban will be in force.
