The parents of Madeleine McCann are to sue former Portuguese police officer Goncalo Amaral for defamation.

Kate and Gerry McCann are to take action over comments made by the man who previously led the botched inquiry into Madeleine's disappearance.

In a statement, they said: "We - together with our three children Madeleine, Sean and Amelie - are taking this legal action against Goncalo Amaral over his entirely unfounded and grossly defamatory claims - made in all types of media, both within Portugal and beyond - that Madeleine is not only dead, but that we, her parents, were somehow involved in concealing her body."

The couple, from Rothley, Leicestershire, said they are taking action because his claims that Madeleine is dead are hampering the search for their daughter.

The decision was taken in a bid to prevent further publication of Amaral's "deeply offensive" book The Truth of the Lie.

Also his TV documentary, and his "disgraceful thesis" that they were involved in their daughter's disappearance.

The statement continued: "The primary reason for our legal action is simple: to stop any negative effect that these absurd and deeply hurtful claims may be having on the ongoing search for Madeleine.

"We can no longer stand back and watch as Mr Amaral tries to convince the entire world that Madeleine is dead.

"Nor can we allow this blatant injustice to Madeleine, with its obvious risk of hindering our attempts to find her, to continue.

"Mr Amaral's entirely unjustified claims have not only brought indescribable devastation and suffering to our lives, they have hugely compounded the already immense pain and anxiety we have endured since Madeleine's abduction."

Madeleine disappeared two years ago in Praia da Luz, Portugal, while her parents dined in a nearby tapas bar.

At last!! Excellent news. And I love the media statement and the powerful language in which they have announced their intentions and their description of their hurt and their anger. Strong stuff and I applaud them both. This is what Amaral has been striving for of course. Let him now try it in a court of law! God Bless them both.

The next best news I could hear next to Madeleine being found! That it was grossly harming the search for Madeleine is exactly what was pointed out in the book written by members of this forum!

Heard the news during the 8 o'clock news on SIC tv. Couldn't get all of it, it seems the couple is looking for a lawyer specialised on this type of cases. There aren't many around, I think, but there are fine ones, their current lawyer will be able to advise them about it. Anyway, I just popped into Sky LoC, so soon and there are reactions there already!

I too am glad that they finally are fighting back.

The irony is that all his new found wealth will be used to help find Madeleine, it couldn't happen to a nicer person.

I am pleased to hear this news. I did predict that when Amaral made his claims/accusations in a country with far more stringent libel laws than Portugal, that action would be taken against him.

Perhaps the Netherlands was just the place.

I still hold reservations about sueing in Portugal, as Maria has explained many times that Portugal does not hold libel in the same serious light as many other countries. I would be interested if anyone can show who holds the burden of proof in Portugal, is it the libeller or the one being libelled. In Britain, the person doing the libelling must prove that what he/she says is the truth, which of course Amaral cannot do, and this is the reason why no one in Britain will publish his book. Is this the same for Portugal? The other thing is damages. If libel is not considered serious in Portugal, then it is unlikely that any court will award significant damages (after all not serious), meaning that the cost of the action will outweigh the payout. BUT if they are even close together, then it is worth it to let the Portuguese people to know they have been duped and unknowingly assisted a man in his failure to find a missing child.

But there is always the chance that this could become a landmark case in Portugal. I mean how much worse can libel get than to accuse a grieving couple of killing their child, disposing of her body and then carrying on a fraudulent campaign to find her, as well as the other numerous lies and accusations made against them. This is the type of case that could change the way libel law is viewed in Portugal.
