I think he's been to the CAB to try and save money by the sounds of his reply

Bennett's reply is like a law student writing an assignment (well the bits I read, I have already sacrificed far too much of my life by reading the other letter).

2 points.

1. Already said over and over that sending a piece of libellous crap to the McCanns for comment doesnt mitigate the libel contained in the piece. It is up to the author to ensure it is correct.

2. And so what if Gerry says on his website that they are not going to dignify the Houndation with a comment. He didnt say they werent sueing them for libel. And we did warn Bennett and his cohorts that taking legal action didnt require any comment. But once again they chose not to listen.

So much more could be said, but better to sit and watch. This is quite enjoyable.

Rosie I hope you keep us up to date when it reaches court.
I cant help wondering, if TB has taken legal advice and will require a Barrister, then why has he put together such a lengthy reply to CR?
I am sure no lawyer or barrister would have advised him to reply at length in this instance?
I seem to think he is acting for himself?
If he has taken legal advice, then Butler should make sure she hears every word of the legal advice rather than just take TB word for it.
He does appear to have a habit of protecting his own backside first doesn't he?

bennett's biggest mistake was confusing 'No comment' with 'No action,' The McCann's are not obliged to reveal their plans to the Bald Illegal, however important he thinks he is. As for his begging for more time, he should have responded the very day those letters dropped onto his doormat, like most sensible people like you or me would have done. He did nothing. Exactly how long did he THINK he had before he had to respond? A week? A month? In his OWN sweet time? He gambled it was a bluff, and he lost. Now comes payback time. C-R's reply to his request will be short and sweet. No deal.

wish also to correct a further inaccuracy I have noted on page 2 of
your letter. The final paragraph of your letter states: “…you recently
chose to plumb new depths by posting leaflets to residents of the
village in which our clients live with their children”. I must inform
you that I have never ‘posted’ or delivered or distributed any of the
‘10 Reasons’ leaflets nor indeed any other information or leaflet about
Madeleine to anyone in Rothley. You need to withdraw that claim from
your letter.

Its a form of terrorising imo, and the brevity of their situation still hasnt sunk in from what ive heard.

Does this idiot think that being below the tax threshold puts him above the law?

All along he has played this card that since the McCanns hadn't entered into dialogue about his leaflets, that it meant they couldn't refute the accusations contained within them. It makes me so angry that this blithering idiot thinks that the McCanns should have put the search for their daughter on hold to entertain his meddlesome cr*p. The fact is that they have endured this hate campaign for two years because they wanted to focus on finding Madeleine.

I really hope they follow this through now. I am utterly convinced that nothing short of a jail sentence will stop this pest. If they don't follow it through, he will trump success and up his game.

I see from Stevo´s reply to TB´s letter - no.69 - that he has no intention of closing down the MF site until Tony and Butler request it which he doubts. He also said that the law cannot close it down as it is in the US not UK domain. So it has begun......

Believe me Rosie I am not pessimistic about Carter Ruck, quite the contrary. I am just trying to fast forward into the future because there are always going to be evil doers out there, even if TB and Butler are carried off tomorrow. For me anyway this whole issue is not about them. It´s much more interesting than that. I think it has to do with how one protects the individual from trial by internet.
But you are right. Let´s wait and see how things pan out. Can´t wait for the next instalment!

I think it will not matter where the server is for a site, Bennett and Butler are in the UK, they have to abide by UK laws, although his remains to be seen, I do not think they will be able to open a website up in another country, they will still be in breach of law in this country. I think he would have to move to another country to do this, but even then I think the UK could still act and what country will allow him to do this after the trouble has has caused?

There is also this law change coming up which will cover hate sites etc on the internet, Vee knows more about this than I do.

I do not think there is any doubt about it now, both Bennett and Butler are in serious trouble and I have to say this, I think this is just the tip of the iceberg, I feel that there has to be more to come!

The most ridiculous thing is that Butler is down as the Founder and chair of the Foundation, this must mean that it is registered to her, she is supposed to be a business woman, then in my opinion, she cannot be a very savvy one as she does not appear to be able to grasp the true extent of the trouble they are in and is still playing games at Madeleine's expense! It is all going to end in Butler's tears she stands to lose everything and Bennett, who is free with Butler's time and money etc, stands to lose nothing, this is why he is so vociferous, still if Butler doesn't care, why should we?

Lawyers for Madeleine McCann's parents make demand that a website is taken down.

Lawyers representing Kate and Gerry McCann have demanded a website claiming their daughter was not abducted be taken down.

The Madeleine Foundation claims Madeleine is dead and her parents bear some responsibility for her death.

In a statement on its website, the foundation says libel specialists Carter-Ruck have also demanded they hand over all remaining copies of leaflets and booklets they published to support their claims.

The spokesman for the McCann family, Clarence Mitchell said: "Kate and Gerry have consistently made it clear they will not dignify the actions of the so-called Madeleine Foundation with any comment whatsoever.

"However Carter-Ruck's position is now clear and it is in the hands of Kate and Gerry's defamation lawyers."

The statement on the foundation's website states they were given until Friday to reply to Carter-Ruck's letters and were now taking legal advice.

Madeleine was nearly four when she vanished from her family's rented holiday apartment in Praia da Luz on May 3 2007 while her parents dined with friends nearby.

Mr and Mrs McCann, both doctors from Rothley, Leicestershire, tapped into the huge public interest into their daughter's disappearance and made repeated appeals for information.

They feared their daughter had been abducted and taken abroad and set up an official findmadeleine.com website as part of their campaign to be re-united with their daughter

So he says, but honestly, he tells so many sotries that later turn out to be false that I honestly do not believe him, didn't he say he was going to Austria next month? osie what is there to stop TB from handing over the whole site to a US citizen (or European or Australian wherever)? He can be described loosely as a "Consultant" for legal purposes - he´d love that of course. Still the same game, same ethos, same cr-p..just not legally HIS own site. Same bl--dy leaflets without his name to it, reprinted and available as a download.......don´t tell me he hasn´t thought about it.

Hi Rosemary, I really would not worry too much what Stevo says, he is already in much more trouble than he can handle, he is being investigated himself and as he is a Brit in the US, he could be in serious trouble, like kicked out of the country serious trouble, for what he has been up to.

There will be a way that TB can be stopped and Stevo simplistic knowledge of the law is a joke, he was quoting the "fair use" doctrine the other day and making a complete pigs ear of it. At the end of the day, Bennett is committing libel and the US have already said they will work with their counterparts in the UK to stop this. Bennett is going down and mark my words, this civil action will soon be the least of his worries!

PS He is living under the tax threshold he says so he´s bound to be helping himself to whatever benefits are available to him. And he´s probably being helped out by his poor old mother as regards holidays, maybe she has a house too?

That´s his big problem isn´t it Rosie? He can´t afford his day in court. Unless all his followers set up a Bennett Foundation of course? As if!

Now thats a real shame NOT! It just means he will probably have to serve time . He's probably claiming benefits he shouldn't be as at 62, he can only get pension credits.
