Last Friday 15th January 2010 was only for the judge listen to 3 witnesses of Goncalo Amaral's. (Grade, Pinheiro and Cabrita). Leandro was not present, as it was not necessary. This is NOT the trial yet. It is just to confirm the accusation of the Public Prosecutor against Goncalo Amaral by a judge, at the request of Amaral himself. Leandro's lawyer (Dr Marcos Aragao Correia) will be notified by the court of the next date for aditional procedures, (if there are more). Otherwise, the judge will book a date for final allegations, and then decide if the accusation is is OK. If it is then the court will then book the date for the beginning of the trial. Otherwise, Leandro must appeal to the superior court (Tribunal da Relecao de Évora). Marcos believes the accusation of the Public Prosecutor will be confirmed. But if not, then they will definitely appeal!

Marcos (Dr Aragao Correia - lawyer) has received the notification of the Judicial Court of Faro informing him that the next day booked for the instruction phase of confirmation of the accusation against Goncalo Amaral will be on 17 of February. This will be the final day, and it’s reserved for the oral interventions of the lawyers.
After that day, the judge has a maximum of ten days to decide to confirm or reject the accusation against Amaral (article 307 n3, Portuguese Penal Procedure Code). If it’s rejected Leandro and Marcos can appeal, but if it’s confirmed, Goncalo Amaral will not be able to appeal anymore, and the judge will immediately order to the court a date to begin the trial against him for crimes of torture committed against the stepfather of Joana (article 310 n1, Portuguese Penal Procedure Code). So, this coming session on 17th February is a very important session.

Boy, Amaral is going to be busy in February - hope he doesn't forget Feb. 14 is Valentine's Day and he can remember his lovely wife and his mistresses! February is when the continuation will continue for the permanent ban of the book? I think Amaral will be too stressed out to remember Valentines Day - so don't count on flowers or chocolates Ms. Morais!
