The lawyer Marcos Aragão Correia and Professor António Pedro Dores, accused of defaming former Inspector of Judicial Police Gonçalo Amaral, now know the decision of the Court of Faro, and the prosecutor asked for acquittal.
Leonor Cipriano's lawyer, Aragão Correia, and the president of the Association Against Exclusion for Development (ACED), Antonio Pedro Dores, are accused of defaming the former inspector, who investigated for nearly eight years the disappearance of Jane, daughter of Eleanor Cipriano.
The complaint, filed by Gonçalo Amaral, now retired, was prompted by an April 2008 document titled "Report on Torture Leonor Cipriano perpetrated by the Judicial Police," which Aragão Correia prepared for ACED and was broadcast by the association.
In 2009, Gonçalo Amaral was sentenced to eighteen months' imprisonment suspended for making false allegations in the trial of former inspectors and officials accused of torture PJ's mother Joan.
However, the former inspector considered that this report was "damaging the honor and consideration personal and professional" and therefore decided to refer Aragão Correia and President of ACED, for defamation.
The Public Ministry (MP) asks for absolution, and argues that both failed to make sense to talk about defamation, since all evidence points to the existence of torture, despite never having tasted exactly your own.
Heard as a witness in closing arguments of the trial, Leonor described the inspectors put a bag over his head, kicked around the body and hit him with a telephone card and a blunt object.

Breaking news:
NOT-GUILTY of all charges;
the torture of Leonor Cipriano perpetrated by the portuguese police is once again confirmed;
the serious and active involvement of Goncalo de Sousa Amaral in that torture is once again confirmed;
Goncalo de Sousa Amaral was condemned to pay all the court expenses;
since the Public Prosecutor also asked for the non-guilty verdict, no more appeals are possible.

As for Marcos Aragão Correia, cemented his acquittal in the fulfillment of civic duty to denounce acts of torture that is required every citizen and, on the other hand, has proven that as the lawyer for Leonor Cipriano was convinced that Gonçalo Amaral was the same co-author of the acts of torture against the mother of Joan.
By having knowledge of the acts committed against Leonor Cipriano - whose existence, as an autonomous object of judgment, the court did not question - through a conversation with your client, Aragão Correia became convinced of the veracity of the version heard, which, in the opinion of the court annulled the severity of their publication.
However, based on the testimony he heard - including that of Leonor Cipriano - the court failed to establish that Gonçalo Amaral has witnessed acts of torture or even coordinate the team that practiced.
On the other hand, claimed that Aragão Correia knew someone publicly attributed those acts could constitute matters "offending the honor and dignity," though it has done so in the belief that Eleanor had told the truth.

Marcos Aragão Correia is a lawyer of the mother of Joana, he was the author of a polemic report, he, who wrote that GA saw Leonor Cipriano being tortured in the PJ in Faro without doing nothing to prevent it, he was accused of defamation, a crime that the court understood it happened but it shouldn´t be punished.
Marcos lawyer: the court understood that, nevertheless, being filled the elements of the crime, it is not, he didn´t commit, in this case, the arguido illicit conduct, because reported those acts as of higher social interest and understood that being as truthful.
Journalist: this means that Aragão Correia limited to put in paper what Leonor told him and trusted to be true, acted according court with the conviction that it was denouncing a public crime, a violation of human rights, that´s why he was absolved.
Marcos lawyer: so, the court filed well and we´re satisfied with the decision, we feel that justice has been served.
Journalist: the report was subscribed by a responsible of the SOS Prisons, accused of the same crime, also absolved.
Journalist: Amaral was not in the court, TVI tried, without success, "to know his reaction to the sentence". Leonor Cipriano and brother John were condemned to 16 years in jail, by the death of Joana, in September of 2004, the woman complained of being assaulted in the directory of Faro PJ, five inspectors were at trial, the court proved the aggressions, but the authors were not identified.

Marcos Aragão Correia is a lawyer of the mother of Joana, he was the author of a polemic report, he, who wrote that GA saw Leonor Cipriano being tortured in the PJ in Faro without doing nothing to prevent it, he was accused of defamation, a crime that the court understood it happened but it shouldn´t be punished.
Marcos lawyer: the court understood that, nevertheless, being filled the elements of the crime, it is not, he didn´t commit, in this case, the arguido illicit conduct, because reported those acts as of higher social interest and understood that being as truthful.
Journalist: this means that Aragão Correia limited to put in paper what Leonor told him and trusted to be true, acted according court with the conviction that it was denouncing a public crime, a violation of human rights, that´s why he was absolved.
Marcos lawyer: so, the court filed well and we´re satisfied with the decision, we feel that justice has been served.
Journalist: the report was subscribed by a responsible of the SOS Prisons, accused of the same crime, also absolved.
Journalist: Amaral was not in the court, TVI tried, without success, "to know his reaction to the sentence". Leonor Cipriano and brother John were condemned to 16 years in jail, by the death of Joana, in September of 2004, the woman complained of being assaulted in the directory of Faro PJ, five inspectors were at trial, the court proved the aggressions, but the authors were not identified.

Look now, we all know that Amaral was involved in the actual Torture but for some inexplicable reason The Court was unable to prove it. Although The PJ must know who was in The Police Station at the time. For God's sake, the Torture went on for several hours, and Leonor will not have been silent will this was going on.

Gonc didn't attend court,
neither did Cristoavo or Cabrita.

I find it interesting that a defense to defamation was that Marcos said what he said in good faith, in that he was told of the torture by Leonor. I think this would only hold up because she said it under oath.
The only issue really is whether or not Gonc committed the torture, knew of the torture, ordered the torture or knew nothing of it. It is now considred a fact that the torture occurred. Plus, Gonc was convicted of lying about the torture(effectively if not exactly). I wonder if it would have gone that way had Gonc not been convicted. Regardless, the torture is real, so why has the conviction of Leonor not been found to be unsafe and overturned?
