Judgment on crimes in the house of Elvas is 6. Monday

The Casa Pia case back on Friday to trial in the first instance, after the Lisbon Court of Appeal have sent repeat the production of evidence relating to alleged sexual offenses against former students casapianos a villa in Elvas.
By decreeing the nullity of the judgment on the events in Elvas, the relationship turned out to benefit the defendants who were allegedly involved in these facts: the lawyer Hugo Marcal, Carlos Cruz and Carlos Silvino. Also included Gertrudes Nunes, who had been acquitted.
For the defendant Hugo Marcal, which in the Casa Pia answered only by events in Elvas, the relationship did not impose any penalty because the nullity of this part of the judgment made the case concerning the lawyer by profession lowered the first instance where the issue must be reconsidered. On appeal, the Appellate Court failed to appreciate, so the three crimes charged by prosecutors in the attorney Elvas.
As for the TV presenter Carlos Cruz and accused the judges of Appeal did not consider the crime of Elvas by which he had been convicted, but have proved to the commission of other crimes of sexual abuse of children, so they redid the penalty, the resulting accumulation of penalties in a single penalty of six years in prison.
As for Carlos Silvino, the nullity of the judgment in relation to events in Elvas meant that the ratio does not take into account three crimes alleged against him in that locality, and in reshaping the accumulation of penalties being applied to a single penalty of 15 years in prison.
For Gertrudes Nunes, who had been acquitted in the first instance, the partial invalidity of the judgment of first instance, namely the situation that occurred in Elvas, requires a new appraisal of the facts surrounding the defendant.
The Court of Appeal held, however, in full sentences at first instance to the former deputy provider of Casa Pia Manuel Abrantes (five years and nine months), the diplomat Jorge Rite (six years and eight months) and doctor Joao Ferreira Diniz (seven years in prison).
The judgment of first instance, who had six of the seven defendants sentenced to imprisonment effective, was delivered in September 2010 after a legal marathon that lasted nearly six years, in which nearly a thousand witnesses were heard.
With the exception of Carlos Silvino "Bibi", none of the defendants admitted the practice of sexual abuse of minors, claiming incocência.
The collective of first instance, chaired by Judge Ana Peres condemned Carlos Silvino (18 years), Cruz and Carlos Ferreira Diniz (7 years), Jorge Ritto (6 years 8 months) Hugo Marcal (6 years 2 months), Manuel Abrantes (5 years 9 months) and acquitted Gertrudes Nunes. The convicts were also obliged to pay compensation to victims.
The Casa Pia case began to be tried on November 25, 2004.

On the afternoon of this Friday, the court merely report the change of the facts that led the process to return the first instance, in the case a date of the crime, and the application deadline for attorneys to defend its case, including testimony of witnesses. The defense of Carlos Cruz objected to this schedule, and remembering that the process is urgent, the lawyer Ricardo Sá Fernandes said it was not reasonable markup for September 7.
Judge Ana Peres indicated the processes at hand, to demonstrate the lack of agenda, including the case of the Independent University. In response to the defense of Cruz, the prosecution considered the application for Sá Fernandes as foolish and demagogic.

The Supreme Court confirmed on Thursday the decision of the Lisbon, who applied 15 years in prison on Carlos Silvino da Silva, a former Casa Pia driver, known as 'Bibi', judged by hundreds of sexual abuse.

Ex-driver known as 'Bibi' had seen the penalty reduced by the Lisbon
Sentenced to 18 years in prison in 2010 , the main accused in the case of pedophilia saw his sentence reduced in February, following the decision of the judges to separate processes and arrange for the first instance crimes in the house of Elvas, whose trial continued in September .
'Bibi' was the only defendant to appeal to the Supreme, as was also the only one sentenced to more than eight years in jail, a condition that allows use of the highest court.
The remaining convicts - Carlos Cruz, Ferreira Diniz, Jorge and Manuel Abrantes Rite - Can I just turn to the Constitutional.
